Contest Rules
NO PURCHASE IS NECESSARY TO ENTER THIS CONTEST (THE “CONTEST”). A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
The sponsor and administrator of this Contest is The ALDO Group Inc., 2300 Emile Belanger St., Montreal, Quebec, Canada, H4R 3J4 (“Sponsor”).
The Contest is open to all legal residents of Canada, the United States and the United Kingdom who have reached the age of majority (18 and over) in the territory in which they reside at the time they enter the Contest. The Contest is not open to employees, directors and officers of Sponsor and those of its affiliated and associated companies, agents, advertising and promotional agencies as well as to the members of their respective immediate families living in the same household. Sponsor reserves the right to verify eligibility qualifications of all winners. Void where otherwise prohibited by law.
By participating in the Contest, each participant accepts the terms and conditions of these Contest rules and regulations (the “Rules”) and agrees to be bound by them. The Contest is subject to all applicable laws and regulations including any federal, provincial, state and local laws. The Contest is void where prohibited by law.
The Contest begins at 12:00 am Eastern Time (ET) on October 23, 2017 and ends at 12:00 pm ET on January 15, 2018 (the “Entry Period”). All entries must be received by the end of the Entry Period. Receipt of an internet entry occurs when the site’s servers record the entry information resulting from entrant clicking the “continue” button.
To enter this Contest, you must complete the survey sent by email and provide all the information requested and click “Submit” during the Entry Period. By successfully transmitting a completed online survey as directed, you will be entered in the Contest. Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible. Limit of one entry per person. Automated or robotic entries submitted by individuals or organizations as well as incomplete ballots and will be disqualified. There is a limit of one (1) entry per Entrant.
A random draw will be held at the offices of Sponsor in Montreal, Quebec, on January 29, 2018, to select the potential winners, among the eligible entries received. There will be a total of four (4) winners. Each winner will be entitled to one Aldo gift card (the “Prizes” and individually the “Prize”) as follows: one (1) winner in Canada will win a CAD$250.00 gift card, two (2) winners in the United States will each win a USD$200.00 gift card and one (1) winner in the United Kingdom will win a GBP£150.00 gift card. The potential winners will be notified by email on February 1, 2018 (the “Time of Notification”) and will be required to sign and return a declaration of eligibility within forty-eight (48) hours following the Time of Notification, failing which the Prize will be forfeited and awarded to an alternate winner selected by random drawing from all eligible entries.
The Prizes will be sent by mail to the winners within two (2) weeks of receipt of the declaration of eligibility.
Any and all applicable federal or provincial taxes (including income and sales taxes) are solely the responsibility of the winner.
Odds of winning the Prizes will vary depending on the number of eligible Contest entries received.
To win the Prizes, the potential winners must comply with these rules and correctly answer a time-limited mathematical skill-testing question (without the assistance of another person or mechanical device) to be administered by email at the Time of Notification.
Sponsor will not be held responsible for unsuccessful attempts at notifying the winner of their win, nor for late, lost or misdirected notifications of wins. If Sponsor is unable to communicate with a selected winner, or if a winner does not possess the required eligibility qualifications or does not comply with all the rules herein specified, the Prize will be forfeited and awarded to an alternate winner selected by random drawing from all eligible entries.
If, by reason of a typographical or other error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available. No more than the advertised number of prizes will be awarded.
The gift cards can only be used in Aldo stores (excluding e-commerce) in Canada, the United States and the United Kingdom, as applicable per the winners’ countries and cannot be redeemed for cash, transferred, assigned or substituted, except that Sponsor reserves the right to change or replace the prizes at any time in its sole discretion with prize(s) of greater or comparable value. Sponsor will not replace any lost or stolen Prizes.
Sponsor assumes no responsibility for lost, stolen, mutilated, late, misdirected or ineligible entry forms. All entries become the property of Sponsor.
By entering this Contest, each participant grants to Sponsor, if he/she wins a prize hereunder, a non-exclusive, worldwide, perpetual, irrevocable license and right to use, display, alter, modify, publish, transmit and prepare derivate works of the participant’s photograph, voice, name, hometown, image and likeness in whole or in part in and in connection with the publicity, advertising, exhibiting, marketing, promotion and exploitation of the business of Sponsor in any manner and in all media throughout the world without any compensation, consideration or consent.
By entering this Contest, each participant agrees to be bound by these official rules and the decisions of Sponsor, which shall be final. Sponsor and its parent companies, subsidiaries and affiliates, officers, directors, employees, shareholders and representatives, advertising, and promotional agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use of any prize, or from participation in the Contest; (v) any printing or typographical errors in any materials associated with the Contest; or (vi) any damage to any computer resulting from playing, entering or downloading any materials as part of the Contest. With the consent of the Régie des alcools, des courses et des jeux du Québec, Sponsor reserves the right, in its sole discretion, to suspend or cancel the Contest at any time if a computer virus, bug, tampering, fraud, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Contest. Sponsor reserves the right to cancel the Contest or change any element thereof, with or without notice, at any time, due to printing errors, Web Site errors, transmission errors or other mistakes in the production of the Contest. Sponsor also reserves the right to disqualify, in its sole discretion, any person tampering with the entry process, the operation of the Web Site, or who is otherwise in violation of the rules. Participants agree that any and all disputes will be resolved individually, without resort to class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees. The participants’ use of Sponsor Web Site is also governed by the Website Terms which can be found at http://www.aldoshoes.com.
In case of dispute as to the identity of any participant who has provided an email address, entry will be declared made by the Authorized Account Holder of the email address submitted at time of entry. As used in this Contest, "Authorized Account Holder" is defined as the natural person who is assigned an email address by an internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry.
BY ENTERING THIS CONTEST, EACH PARTICIPANT RELEASES AND FOREVER DISCHARGES SPONSOR AND ITS PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AGENTS, AND ADVISORS AND THE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND REPRESENTATIVES OF SPONSOR, OF AND FROM ANY AND ALL DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND WHATSOEVER ARISING IN CONNECTION WITH THE CONTEST OR RESULTING FROM ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THIS CONTEST, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH, AND/OR PROPERTY DAMAGE AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY. EACH PARTICIPANT IS FURTHER RESPONSIBLE FOR ANY CLAIMS OR DAMAGES RESULTING FROM THE SENDING OF AN EMAIL TO A FRIEND TO SUGGEST TO SUCH FRIEND TO PARTICIPATE IN THE CONTEST. SHOULD SUCH A CLAIM OR DAMAGE ARISE, THE PARTICIPANT SHALL INDEMNIFY AND HOLD SPONSOR AND ITS PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AGENTS, AND ADVISORS AND THE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND REPRESENTATIVES OF SPONSOR, HARMLESS THEREFROM.
This Contest is subject to the laws of the province of Québec and the federal laws of Canada.
For the names of the prize winners, mail a self-addressed, stamped envelope to: "ALDO survey prize, wide width study", c/o ALDO Marketing, 2300 Emile Belanger St., Montreal, Quebec, Canada, H4R 3J4. Allow two (2) to four (4) weeks for delivery.
With respect to the province of Québec, any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux du Québec. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
